Decision Imposing an Administrative Penalty Declared Invalid Due to Procedural Violations

The client approached our law firm to challenge an administrative penalty imposed by an administrative authority, as the client believed that the administrative liability imposed was unlawful.

In such cases, the protection of an individual’s rights, as well as the judicial challenge of administrative acts that have violated or may violate a person’s rights and legitimate interests, are of crucial importance.

After taking on the case, our lawyers conducted a comprehensive legal analysis, examining the administrative act, the factual and legal grounds for its adoption, the applicable legal provisions, and the procedures followed. Based on this analysis, a clear litigation strategy was developed aimed at having the administrative act declared invalid. The claim filed with the court sought to declare the challenged decision invalid and restore the client’s violated rights. At this stage, the proper application of administrative procedure rules and the collection and submission of relevant evidence were of particular importance.

During the court proceedings, our lawyers demonstrated that the challenged decision did not comply with the legal requirements applicable to administrative acts and had been adopted in violation of the prescribed procedures. The arguments and evidence presented demonstrated that the administrative authority had failed to properly comply with the mandatory procedures required for adopting the decision, thereby restricting the client’s rights. Having comprehensively assessed the circumstances of the case and the evidence, the Administrative Court upheld the claim and declared the decision imposing the administrative penalty invalid.

The opposing party attempted to challenge the judicial act by filing an appeal. However, as a result of our consistent efforts, the Court of Appeal dismissed the appeal and upheld the judgment of the Administrative Court. Subsequently, the administrative authority also filed a cassation appeal; however, the appeal failed to meet the formal and procedural requirements established by law. In particular, the judicial act was incorrectly identified in the appeal, and the required evidence was not attached. As a result, the Court of Cassation returned the appeal.

As a result, the judicial act rendered in the client’s favor remained unchanged and entered into legal force, while the legal consequences of the decision imposing the administrative penalty were eliminated. Thus, the client’s violated rights were restored and the negative consequences of the unlawful imposition of administrative liability were prevented.

The case is a successful example of how a decision of a state authority can be effectively challenged through proper factual and legal substantiation.

In such cases, the proper application of administrative law, effective judicial protection, and professional legal services play a crucial role in restoring a person’s violated rights.

Our experience demonstrates that a well-chosen strategy, in-depth legal analysis, and consistent work at all stages of judicial protection can also be decisive in disputes with state authorities.
