Our law firm was approached by a client who had effectively ceased living together with her husband and wished to resolve several important matters arising from their family relations through judicial proceedings. The primary issue was the determination of the minor child’s place of residence. Since the parents were no longer living together, it was necessary to determine with which parent the child should reside, giving primary consideration to the best interests of the child. The proceedings also involved claims concerning divorce and the division of property acquired during the marriage.

The client’s primary objective was for the Court to determine the child’s place of residence as being with her, as the mother, guided by the principle of the best interests of the child. Family disputes concerning the determination of a child’s place of residence require not only in-depth knowledge of family law, but also an individual assessment of the circumstances of each case, as the protection of the child’s rights, normal development, and well-being lies at the heart of such proceedings.
After taking on the case, our lawyers conducted a comprehensive examination of the case materials and factual circumstances. We analyzed the family legal relations that had developed between the parties, the applicable family legislation, and judicial practice, including the legal positions of the Court of Cassation of the Republic of Armenia and the Constitutional Court concerning the principle of the best interests of the child. Particular attention was paid to the criteria which, when assessed together, could establish which parent’s household would best serve the child’s interests.
Our lawyers developed a legal defense strategy based on the principle of the best interests of the child. In the factual and legal arguments presented to the Court, we emphasized that the issue of a child’s place of residence cannot be determined on the basis of a single circumstance. It is necessary to assess together the child’s age and attachment to each parent, the relationship between the parents, the personal and moral characteristics of each parent, as well as the conditions provided by each parent for the child’s upbringing, education, and normal development.
During the proceedings, the Court also examined the conclusion of the Guardianship and Trusteeship Authority, which was of significant importance in assessing the child’s living conditions and interests. In accordance with the requirements of family legislation, the Court also heard the opinion of the child, who had reached the age of ten. The child stated that they wished to continue living with their mother, as they were already living in that environment and felt safe and comfortable there. The Court also took into account the fact that the father did not object to the child’s place of residence being determined as the mother’s place of residence. The combined assessment of these circumstances was of significant importance to the outcome of the case.
During the court proceedings, our lawyers presented factual and legal arguments, emphasizing that maintaining the stable living environment already established for the child, continuity of education, normal development, and psychological stability supported the child’s continued residence with the parent under whose care the child had in fact been for an extended period. We also presented relevant evidence confirming that the client had provided the conditions necessary for the child’s health, safety, and normal development.
During the proceedings, the subject matter of the divorce claim ceased to exist, as the marriage had already been dissolved through state registration. The client also withdrew her claim for the division of property acquired during the marriage, taking into account the circumstances that had developed. Consequently, the proceedings were discontinued with respect to those claims, and the judicial examination focused on the central issue of the case — the determination of the child’s place of residence.
The Court comprehensively assessed the evidence in the case, heard the child’s opinion, examined the conclusion of the Guardianship and Trusteeship Authority, and took into account the other factual circumstances of the case. As a result, the Court concluded that determining the child’s place of residence with the mother was in the best interests of the child, upheld this claim, and also ordered the respondent to reimburse the client for the state duty paid.
This case once again demonstrates that family disputes concerning the determination of a child’s place of residence, divorce, and the protection of parental rights, particularly where judicial proceedings are required, call for the professional assistance of experienced lawyers and an individualized approach tailored to the circumstances of each case. Ensuring the best interests of the child in such cases requires an in-depth analysis of family law provisions, the presentation of relevant evidence, and the development of a legal strategy tailored to the specific circumstances of the case. Accordingly, the assistance of an experienced lawyer, proper representation before the court, and the provision of legal services can play a decisive role in effectively protecting the rights of both the child and the parent.
