Claim for Debt Recovery Under a Supply Contract Dismissed

The client contacted Fidelis Law Firm to obtain legal assistance regarding a debt recovery lawsuit filed against them. The plaintiff claimed that under a supply relationship established between the parties, the client had failed to pay in full for delivered goods, demanding the collection of the alleged outstanding debt together with accrued interest for delayed performance.

A legally binding court ruling had previously been issued within the framework of the same legal relationship, which the plaintiff referenced to substantiate its new claim. Under these circumstances, it was necessary to evaluate both the factual and legal grounds of the presented claim, as well as the significance of the facts established by the previous court decision for resolving the present dispute.

Upon taking on the case, our lawyers conducted a detailed review of the statement of claim, the supporting evidence attached, the supply legal relationship formed between the parties, tax invoices, and payment data. A separate examination of previous court decisions was carried out to ascertain precisely which facts had been established and to what extent they pertained to the amount demanded under the new lawsuit.

Based on the legal analysis, our team developed a procedural strategy aimed at protecting the client’s property interests. The core defense centered on the evidentiary sufficiency of the claim—specifically, whether the documents submitted by the plaintiff were adequate to prove the delivery of the disputed goods and to establish the client’s payment obligation for them.

During judicial proceedings, our lawyers presented factual and legal objections against the lawsuit, addressing the evidentiary value of the tax invoices, whether the supplies reflected therein were verified, and the calculation of the requested debt. It was emphasized that the prior existence of supply relations between the parties and the issuance of a court decision on individual transactions must be distinguished from the validity of the specific supplies and monetary claims underlying the current lawsuit.

Special attention was given to defining the scope of facts established by prior judicial acts. Our lawyers brought to the court’s attention the necessity of clearly distinguishing which of the facts cited by the plaintiff were already established and which remained subject to proof in this case. This approach was vital for properly assessing the content of past judicial acts and the grounds of the new claim.

The Court of First Instance, having examined the case materials and evaluated the presented evidence, found that the delivery of goods under certain tax invoices was not sufficiently proven. Consequently, the lawsuit filed against the client was dismissed.

The plaintiff filed an appeal against the judgment, contesting the evaluation of evidence and the Court of First Instance’s conclusions regarding the legal significance of previous judicial decisions. In appellate proceedings, our lawyers continued defending the client’s interests, presenting a well-founded position against the arguments of the appeal and substantiating why the judgment of the Court of First Instance should remain unchanged.

The Court of Appeal rejected the plaintiff’s appeal, leaving the judgment of the Court of First Instance intact. Thus, the favorable outcome achieved for the client was upheld at the appellate stage, and the claims for debt and interest recovery against them were fully rejected.

This case demonstrates that in such disputes, effective legal defense is crucial not only for the claimant but also for the defendant. A thorough examination of the documents underlying the claim, verification of the debt calculation, and proper assessment of the legal significance of prior court decisions can be decisive in protecting against unfounded property claims.

If a claim for debt, interest, or other contractual obligations has been filed against you or your company, our lawyers stand ready to examine the grounds and evidence presented, develop an effective defense strategy tailored to your case, and represent your interests in court.
