The client approached us seeking legal assistance in protecting their rights arising from a loan agreement. Under the loan agreement, our client had provided the borrower with a substantial amount of money, the repayment of which was secured by a pledge of real estate. However, the debtor failed to fulfill their contractual obligations and did not repay the loan amount. In these circumstances, it was necessary to initiate court proceedings and apply the legal mechanisms available for debt recovery, seeking recovery of the outstanding debt and enforcement against the pledged property.
We conducted a comprehensive legal analysis of the case, examined the contractual relationship between the parties, and developed an effective litigation strategy. We filed a claim with the Court seeking recovery of the principal debt and accrued interest, as well as enforcement against the pledged real estate to secure satisfaction of the claim. At the same time, the opposing party filed a counterclaim seeking to have the loan and pledge agreements declared invalid, a defense mechanism frequently used in similar civil disputes. We presented a well-founded position before the Court, establishing the validity of the agreements and the existence of the underlying obligation.
During the court proceedings, our legal team ensured the proper protection of the client’s interests by presenting the relevant evidence. Our position was based on a combined analysis of the applicable provisions of civil law, contract law, and enforcement proceedings, demonstrating that the debtor had breached their obligations and was therefore required to bear the consequences provided for by the agreement and applicable law.
The Court of First Instance, having comprehensively assessed the evidence presented, fully upheld our claim and dismissed the counterclaim, confirming the existence of the obligation and the validity of the claims presented.
The respondent appealed the judgment of the Court of First Instance. During the appellate proceedings, our lawyers continued to protect the client’s interests by presenting a well-substantiated response to the appeal. As a result, the Court of Appeal dismissed the appeal and upheld the judgment of the Court of First Instance. The respondent subsequently filed a cassation appeal, but its admission for examination was refused on the grounds that it did not meet the requirements established by law. Thus, the judicial act issued in favor of the client remained unchanged.
As a result, the judicial act issued in favor of the client entered into legal force, creating a real opportunity to enforce the judgment, proceed with the sale of the pledged property, and secure the actual recovery of the debt. This case is a successful example of how a proper and professional approach can make it possible not only to prevail in litigation, but also to secure its ultimate outcome — the actual recovery of the funds owed.
